You retain ownership of the content you post on MindMatch, including your photos, bio and messages. By posting content, you grant MindMatch a non-exclusive, royalty-free licence to use, display and distribute that content within the Platform for the purpose of operating the service.

MindMatch uses a proprietary cognitive assessment system to generate your cognitive type and match you with compatible users. You acknowledge that:
MindMatch offers both free and premium tiers. Premium features are subject to separate pricing and payment terms which will be displayed at the time of purchase.
When payment processing is introduced, all payments will be processed securely through our payment provider. By subscribing to Premium, you authorise us to charge your payment method on a recurring basis until you cancel.
Cancellation and refund policies will be detailed at the time Premium subscriptions are launched. We comply with Australian Consumer Law regarding refunds.
The "Go Exclusive" feature allows two users to commit to an exclusive connection on the Platform. By activating Go Exclusive:
We are not responsible for the outcome of any relationship formed through the Platform.
Your use of MindMatch is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
All content on MindMatch that is not user-generated — including the platform design, cognitive engine, matching algorithm, game content, branding and copy — is owned by MindMatch and protected by Australian and international intellectual property laws. You may not copy, reproduce, distribute or create derivative works from our content without our express written permission.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MINDMATCH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Our total liability to you for any claim arising from your use of the Platform will not exceed the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Your safety is important to us. However, we cannot guarantee the conduct of users on or off the Platform. You are responsible for your own safety when interacting with other users. We recommend:

You can report any user you believe is violating these Terms through the Platform. We review all reports and reserve the right to remove content or terminate accounts at our discretion. We are not obligated to take any particular action in response to a report.
You may delete your account at any time through the Settings page. Deletion is permanent and your data will be removed in accordance with our Privacy Policy.
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Platform. We are not liable for any loss resulting from termination.
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of New South Wales.
We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
