By creating an account or using the MindMatch platform at mindmatchonline.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.
These Terms constitute a legally binding agreement between you and MindMatch, operated by Edward Frame, Sydney, Australia ("MindMatch", "we", "us", "our").
You must be at least 18 years of age to use MindMatch. By creating an account, you confirm that you are 18 or older. We reserve the right to terminate accounts of users found to be under 18.

You agree to provide accurate, current and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You may only create one account. Creating multiple accounts is not permitted.

We reserve the right to remove any content and terminate any account that violates these rules, at our sole discretion.
You retain ownership of the content you post on MindMatch, including your photos, bio and messages. By posting content, you grant MindMatch a non-exclusive, royalty-free licence to use, display and distribute that content within the Platform for the purpose of operating the service.

We do not verify the accuracy of user profiles and do not endorse any user or their content.
MindMatch uses a proprietary cognitive assessment system to generate your cognitive type and match you with compatible users. You acknowledge that:
MindMatch offers both free and premium tiers. Premium features are subject to separate pricing and payment terms which will be displayed at the time of purchase.
When payment processing is introduced, all payments will be processed securely through our payment provider. By subscribing to Premium, you authorise us to charge your payment method on a recurring basis until you cancel.
Cancellation and refund policies will be detailed at the time Premium subscriptions are launched. We comply with Australian Consumer Law regarding refunds.
The "Go Exclusive" feature allows two users to commit to an exclusive connection on the Platform. By activating Go Exclusive:
We are not responsible for the outcome of any relationship formed through the Platform.
Your use of MindMatch is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
All content on MindMatch that is not user-generated — including the platform design, cognitive engine, matching algorithm, game content, branding and copy — is owned by MindMatch and protected by Australian and international intellectual property laws. You may not copy, reproduce, distribute or create derivative works from our content without our express written permission.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MINDMATCH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Our total liability to you for any claim arising from your use of the Platform will not exceed the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Your safety is important to us. However, we cannot guarantee the conduct of users on or off the Platform. You are responsible for your own safety when interacting with other users. We recommend:

MindMatch has a zero-tolerance policy for objectionable content and abusive behaviour. This includes, but is not limited to: harassment, bullying, threats, hate speech, discriminatory language, explicit or sexual content, and any other content or conduct that a reasonable person would find harmful, offensive, or inappropriate.
Any user found to have posted objectionable content or engaged in abusive behaviour will be permanently removed from the Platform. We do not issue warnings for serious violations.
You can report any user you believe is violating these Terms through the Platform at any time. All reports are reviewed within 24 hours of receipt. Where we confirm a violation, we will take action — including permanent account termination — promptly.
Reporting a user immediately removes them from your view and prevents them from contacting you. You can also remove a profile from your matches at any time without submitting a formal report.
You may delete your account at any time through the Settings page. Deletion is permanent and your data will be removed in accordance with our Privacy Policy.
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Platform. We are not liable for any loss resulting from termination.
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of New South Wales.
We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
Registered MindMatch users may generate a compatibility check invite link and share it with anyone — including people without a MindMatch account. By clicking an invite link and completing the check, the recipient agrees to the following terms.
When completing a compatibility check as a guest (without an account), you agree to provide your real first name and to complete the cognitive assessment games honestly. Your first name and compatibility score will be visible to the sender. No other information is shared with the sender unless you choose to create a MindMatch account and form a mutual connection.
If you are a registered MindMatch user who follows an invite link, you can see the sender's first name and your compatibility score. Your extended profile details remain private until a mutual connection is formed. Accepting a connection is always voluntary.
If a MindMatch account is created (or already exists) after completing a compatibility check, a pending connection is created between the guest and the sender. Pending connections expire 30 days after creation. After expiry, the connection request is automatically removed. Neither party is obligated to accept.
Each user may have a maximum of 7 active connections at any time. If either party has reached this limit, a new connection via invite link may be placed in a waiting state until a slot becomes available. Users may free a slot by removing an existing connection.
You may report any invite link you receive if you believe it violates these Terms. Reporting an invite link notifies MindMatch for review and prevents the sender from sending you further invite links. For anonymous guests this is enforced by IP address; for registered users it results in bidirectional removal from each other's matching pool. We will take action against the sender's account where a violation is confirmed.
Users who are in an active Relationship Hub may not create, share, or accept compatibility check invite links. This restriction is enforced by the Platform. It does not affect the Hub or couple-linking features themselves.
